TN for Canadian citizen with past GC application?

Hi guys,

I want to apply for a TN visa, but have a past GC application which was in advanced stage and I was forced to abandon due to family reasons. This was more than 5 years ago.

Will this be an issue when applying for TN or for that matter any kind of work related visa (H1 etc...).

Could someone throw light on this issue?

If you have applied for an I-485, then you have shown immigrant intent. Even if you've filed an I-130, some officers may interpret that as immigrant intent as well.

You may need to get proof from the USCIS that your I-485 or I-130 was officially abandonded, otherwise the officer at the POE may decide that you are not eligible for a TN. Also I suggest that your bring proof of your ties to Canada.

I will take the hint and try to contact USCIS to get info or official confirmation that my GC application is no longer active in anyway.

One thing is when I applied for Gc I was an Indian citizen and now I am canadian. Will that matter in any way?

I have another question.

If I do get a TN and start working do I have to apply for a new SSN or the old one from my prev stay there will suffice?

Perhaps Mr BZuccaro has some input on this and the original question.
