TN and DV Lottery

TN must have no immigration intention,

Can a TN holder still register in the DV lottery? Will the center have your record so that you will have difficulty to get your next TN?

Yes. Only a pending or approved I-485 is explicit proof of immigrant intent.

You can register, and if you never win the lottery, this will not conflict with any future TNs, since filing for and even winning the DV lottery is not immigrant intent. But, if you should win the lottery, you should make plans to process your DV visa at the consulate. Otherwise, if you file for adjustment of status, and file an I-485 and it were to get denied, or if the I-485 is not processed before Sept. 30th, then you may have problems getting a TN in the future.

Yes they will record it only if you actually attempted to get the visa, but if you do consular processing, you will not have any issues.

If you never won the lottery, or for that matter, if you won, but never proceeded to file an I-485, or you never went to the consulate, the POE and the Service Center wouldn't even care.

The bottom line is, you can apply for th lottery, and if you win, do consular processing, and you'll be fine, even if your DV visa is denied.

the other issue is that if you were born in Canada, you cannot acquire a GC via the lottery because the lottery is only for people from countries that do not exceed the annual immigrant quota.
