Hi, I have a TLC applied in category EB3 on April, 2004. It was supposed to have been EB2 but was messed up by some miscommunication between my Company HR and attorneys. I got to know this last year and applied for a PERM in EB2 in Dec, 2006. My PERM labor got approved this January and they have filed for my I-140.
Looks like I just got the recruitment letter from BEC for my original TLC and my Company wants me to cancel my PERM application and proceed with my Traditional.
Does anyone have a similar experience? How long does it take to get the labor cleared after getting the 45 day letter? Is it possible to hold onto my PERM labor as well ( and just withdraw my PERM I-140?).
