Tired of Exploitation, suggestions on Ac 21???

HI Gurus,

I filed my 485 in May 2004 which went under Retrogression. Please my signature for my case details. All these days, I used to have
a hope of getting the Green Card by the end of this year. But After seeing the latest bulletin where EB3 Priority dates are further retrogressed to Jan 1998. I lost that hope of getting the Green Card anywhere soon.

Can some one predict any approval dates and EB3 485 statuses?

My Problem:
I am getting exploited by my present employer like anything.
Initially my job was not a travelling job. but from the past one year, they shifted my responsiblites and made 50% travelling job. Furthermore, they are not at all increasing the salary. It is ridiculous that they have increased only once by 4% in the past 4.5 years.
so, I have to change the job as soon as possible.I am not very clear about using AC 21.
What is the procedure of using Ac 21? Are there any disadvantages using Ac 21?
My present company renews my H1-B as well as EAD/Aps for me and EAD/AP for my wife. I am still working on H1-B status itself though I have EAD.
I will complete my 6 years period by May 2006

My questions:
If at all I change the job and use Ac 21, Will i be considered as working on H1-B or EAD?
If I am considered as working on H1-B, then do i need to transfer my H1 to the future company?
If I am considered as working on EAD, then i guess my H1 status would be automatically revoked.
If the future company does not have any immigration attorney, who would be taking care of my Green card?
Should I take care of renewing the EAD/APs myself? what if any queries are sent by USCIS?

Please advice me.

i think it looks like its been more than a yr since you applied for 140/485. if your 140 is approved. you can use AC21. but the catch is to make the transition to a a "same or similar" job. you have to find that from our LC application. the new job profile in general has to match the old one.
but once you use EAD you cannot use H-1B same for your spouse.

h-1 b can be transferred if you did not complete 6 yrs. it looks like you are close to 6yrs anyway so you cannot claim 7th yr from a new company. you have to use ac21.
if the future co does not have an attorney..just get one on your own. and ask them to coordinate. but at this stage all you are doing is waiting for 485 approval. so i do not think you need any attorney(if your case is complex..you might want one and send the G-28 form to uscis thru your new attorney).

renew your EAD and AP on your own. all you need is your current EAD and AP. just fill the info on that again to the application and track it.
just have your current address on the INS petitions and files ..so that you receive all their communication promptly.

that is all you have to do. other than that....not much..
