Timing of applying for hardship waiver

Hi,

I am currently in the second last year of my training. I know that the time frame for the hardship waiver is long and variable. I was going to ask if someone can guide me if I can apply for hardship waiver on the basis of my daughter this year. I dont know if applying this year would in any way interfere with me getting the DS 2019 from ECFMG for the final year of my training. If it would, then I will have to wait but if not, then I think I should be able to apply.

Your help will be much appreciated.

I did J1 hardship waiver. It took long. You should start as early as possible, because there is a big chance to apply for it again and again after rejection. Even you won it in one time, it will take 6 months (you can find avarage duration on USCIS website). Preparation before the submition may takes months, because you have to write up strong statements and gather strong supporting documents. Finding a good lawyer will take long time.

During the time I was waiting for the good responce after I applied for J1 waiver, I did DS-2019 extention (not from ECFMG). I do not know whether this will stop your funding. At that time, I was not receiving funding from the sponser but just receiving visa support from them. You need an exerienced immigration lawyer that has experience with J1 hardship waiver anyway. Make an appointment with many of them and ask them about your "timing" concern. First meeting is free or reasonable price usually.
 
I am doing J1 hardship waiver now. I applied at the end of 2008, but now still pending. So frustrated!
