timing for filing of 7 th year extension

Hi,
I am in 6th year. I asked my employer to file my 7th year extension. He is asaying as per attorney, that I can't file for 7th year extansion 6 months before h1-b expiry date.

If any one filed H1-B extansion in 5 to 51/2 period time. please give me your contact details I can try to contact you.

the 6 months before end of H-1B is correct. However Yates memo states that you can combine extension with other process like recapture. So, if you recapture now and at the same time file for 7th year extension it is ok. Otherwise you'll have to wait until you are 6 months or less from H-1B 6th year end.

Desi Kallu. Using recapture, were you able to file in the 5-5 1/2 yr timeframe.
