time taken for labour substitution

Hi

How long does it normally take for a company to transfer an existing pre-approved labour to a new person (whom they have agrred to hire).

Is it 4 weeks ?? somewhere I heard that it can be done in a week so am not sure.

If the labor approval certificat eis still with your company, they can apply today. If they don't have it ( like in case they already used it for some applicant who abandonded the process of GC ) then they must have withdrawn the I140. In that case INS does not return the labor approval cert. some times. So company can file with a copy or ask INS to request the Labor approval cert. from DOL.

In everycase they can file immediately.

In any case, preparing LC sub paperwork, 485 application, medicals etc will likely take you several weeks anyway.

GC processing, especially LC sub, requires you to have some faith in your employer., and your employer willing to do extra work on your behalf, generally speaking.

Watch out for LC scams.
