Hello everyone,
I am Canadian PR holder and intend to marry a US citizen who is currently studying. I was interested to know the timeline when i will apply for immigration .
2ndly what will be right approach ? K1 VISA or direct marriage in our home country Pakistan and then apply for immigration.

Appreciate your help .

Less than a year

It is your choice where you marry. The time difference is not significant.

Your future spouse must have the income or resources to meet the support requirement or have a joint sponsor who can do so.

See the USCIS website for information on family based immigration.

You're looking at somewhere between 6-12 months depending on which route you go

Both are viable options.
With the K1, as its a fiance visa you can apply for it 'now' (provided you meet all the requirements) rather than wait to marry. This visa is slightly quicker than a spousal visa.
If you choose to marry first, you dont need to go back to Pakistan- it's entirely up to you where you marry. As long as the marriage is legal and you get a marriage certificate to prove it, then thats all that matters. The spousal immigrant visa (CR1) takes a little longer than the K1, but it is a great visa. With this visa you would become a permanent resident (GC holder) as soon as you enter the US and so there would be no need to wait and pay $1010 for AOS.

Hi

Thanks for info .
However would like to know the total time that process will take from the day the case is filed untill visa becomes available after marriage .I heard that there are qoutas for every country and sometimes one has to wait for years .
rgds,

Each individual case is different regarding times.
K1 could take anywhere between 6-10 months (could be longer, could be shorter).
CR1 spouse visa could be between 8-10months (could be longer, could be shorter).

Theres no way anyone will be able to give you a wholly accurate time frame as each case is different.

Just want to clear something up though.....in your post you say 'until visa becomes available after marriage'. If youre applying for a spouse visa, you must be married before paper work is filed....if going the fiance route you must get married after the visa has been issued and after you have entered the US.

Thanks , I intend to apply after marriage and then move to US . just wanted to know how time will take untill I am eligible to travel to US .
