Time frame for removing conditions (I 751)

Hi all,
The INS guidelines say that in order to remove conditions from a conditional greencard, form I751 should be filed 90 days prior to completion of two years of permanent residence. But currently the processing time in the San Jose center is almost 6 mths. My questions are :

1. Can we file the application MORE than 90 days in advance?
2. If not, what can we do if the conditional green card expires and a new one is not issued? Does the INS give an interim/temporary card or proof of status?

All help is appreciated.

Thanks

Hi;

You cannot apply more than 90 days in advance. But what happens is that within 7 to 10 days of the INS receiving your I-751 (at least that is how long it should take - not in my case of course!) they will send you a receipt notice that will automatically extend your Green Card by one year. Do not lose this piece of paper!

I only know all this because I have just gone through it. If you need any more help, let me know.
