Those in EB3-IND with PD 2001

By now we probably all have I140 approved and we are waiting on 485 approval. I would like to discuss strategies here other than packing the bags up and doing a masters.

The best way out remaining is to file EB2 as we all can show Bachelor's + 5 yrs experience. I think we should find an employer that can work with our current employer so we can file EB2 perm and port our PD.

In thinking so, I realized that with EAD we can now work for more than 1 employer. What if the second employer files for PR seperately ? Can that be even done ? Throw in your ideas....

Yeah I know you, nlssubbu, me etc are in the same boat. We need to look at alternatives. We need to safely apply in EB2 using the perm process and port over our PDs. Can we have another employer process our EBE application and then convince our current employer to allow PD portability ?
 
can you guys form a company and get your GC filed by it?....the company does not have to be just a front for GC filing, it can actually be doing consulting...with you guys as its consultants/employees.......if you can find 20-30 people like you.....who can keep their current job....but join this company as consultant so that they can work part time and get their gc filed......(i think for GC filing one does not have to be a full time employee)

AGC4ME,

I have been thinking about this option but have never given it a serious thought. Maybe it might be better to do this now because the situation doesn't look good in the near term. I do not know much about this option though. Could you give some more details about this so I can talk to my lawyers and see what the options are?

Issues for me working in EAD

My problem is I am working way below my level of competency. I am doing my MS and has 25 years of experiance in IT field. Though I am clearly eligible in EB2, the job profile is not.

I can easily switch to another high profile job, but unable to do so because of this GC process. I am afraid that I will get a job with the similar nature as I will be over qualified for it. I tried using AC21 in the past and did not succeed.

I am struct in this situation right now and if I am not going to get my GC in an year, I will be backing back too for good :)

The idea is with EAD u can work multiple jobs. Saras if u can talk to ur lawyer can u ask him/her these questions

1. Can u work multiple jobs ? (verification)
2. Can 1 of those jobs be partime ?
3. Can the company offering partime job file for ur GC thru PERM in EB2 category ? Or should it be a full time job.
4. While the company has it's own consulting, we may not be actually consulting for it. What are the repercussions if we won't have any paystubs etc ?
5. Or is it better to have this company file Perm EB2 LC and once the LC is approved turn urself in to consultant for this company and continue to work at ur client place ?

My friend has a company in LA. He filed his GC and scores of his friends thru this company and it's going very good. He got is GC in April of this year.

nlssubbu, if u can apply for EB2 perm and port over ur PD without quitting the job, wouldn't that meet ur needs ?

I140 Approved
LC was approved only last October so couldnt file for I 485.
Canadian PR : Landed in April 05 - So have until April 08 before I loose it.
Plan to move to Canada if no progress in visa situation until Jan 2008. Current employer has office in Canada and are willing to continue GC process. If GC comes through will apply for CP and move back to the US.

Only problem is spouse is in school and wont graduate till Jan 09 so she may have to go on F1 and we may have to live apart for 1 yr. Dont want to give up Canadian PR with no sight of US GC.

Pure Maths

Retro is pure Maths. Indians get 50% plus on H1's every year whereas for Green card per country has only 7% quota. It s like trying to squeeze a 4 lane freeway into a small narrow mountain road.
Oh yes not to mention that H4's dont count against H1 quota but dependents count against GC quota.
We are screwed bottom line. Not being Pessimistic but realistic. IUnless some bill is passed. All these LC's being cleared will make matters worse.

for myself I used AC-21 and did a consulting directly to the end client (made a good deal of money), and again joined the client did not submit AC-21 yet,

but now I am thinking again probably to take another consulting job where I can make more money in another couple of years or so and save as much as I can and really not worrry about getting GC, infact I am really cool if these guys keep renewing and let me work here.

I kick myself everyday for not using AC-21 an year before, I also have plans to open a small company and do a direct contract instead of going thru middle man

so if anybody can share some ideas about opening a company with EAD I really appreciate.

I already checked with HR and they are not interested at this point of time. Though they are sympathetic, they did not want to pay more money to attorney and other issues like publishing this in a magazine, weed out people, etc as well.

I am just hanging around and expecting a new physical year will bring me some hope. I am here in US from 2000 and already switched my employer from consulting to join this big firm to have some stability. (I am now using sub-labor though my original labor is still struck in BEC).

I hope I will find the end of the tunnel soon.

Guldukan, I started my LLC on EAD. I've got a modest project already and there my job title is whatever I want. I am the boss. The situation is not ideal of course because it is hard to find clients. At least for me.

Now regarding not sending AC21 EVL letter to USCIS, what happens if you need to renew your EAD and you haven't informed USCIS about the job change ?

Yes, I do have some concerns regarding not filing my second AC21, I still have sometime to renew EAD, I have papers ready, since I am thinking to change job again or open my own company I have not yet filed

I have good relation ship with my old employer, I am pretty sure he will not revoke 1-140, so I am not sure USCIS will be concerened to renew my EAD.

It is good to know you are able to open a company and have your own project, I am also searching for projects I know it is hard to find
 
With EB2 being Unavailable, why would any one want to reapply in EB2 and get stuck. There is hope with EB3 with new fiscal year starting this October

But are they willing employ you as a consultant/contractor ? I think my idea is not clear. There's no additional work or financial burden on ur current employer. They just need to keep us employed in the same title. We will work for a consulting company which will do the advertising and applying for fresh GC in EB2 category and then we will use our old PD. Do I make sense ?

Sandiboy, the strategy is to apply EB2 and port our EB3 priority dates. Since our PDs are in 2001 we have a pretty good choice of being approved within the next year (since EB2 was already in JAN 2003 for IND)...
