Unless you have a reentry permit, you'll have problems trying to reenter the US with the green card, because you've been outside the US for over a year.

However, if you officially surrender your green card at a US consulate with form I-407 you can easily obtain a tourist visa. You should be able to do both the GC surrender and visa application in the same visit. You may need to request some kind of emergency processing, with proof of the funeral or of his death, so you can get a consular appointment and get the passport back fast enough.

However, now that the funeral is already done, it's doubtful if you'll be able to get expedited processing on the visa.

I don't mean to sound harsh but I think his family will be just fine without you. By your own admission you guys fought a lot and called it quits a few times and you wanted to take a break. Let them grieve and deal with this tragedy and stay out of it. You are no wife of his.

I couldn't be at the funeral since it was on Wednesday... And I couldn't get a new passport and all the papers that fast without any proof that he passed. It was really hard not to be able to be there. On Monday I will get Death Certificate... And with that I can try and get urgent processing of papers? I am just so afraid they won't give me a visa. I have to visit his parents, they are so crushed... I have to be strong for them and for his sister and nephew.

You have to be strong for them? Really? Come on now, are you sure you're not just looking out for a permanent green card?
