We are very low priority cases for them. As long as they don't change their attitude it will be like this.

I dont think you have a standing to "sue". Its not a "right" to be granted a green card. If they want, they can disqualify your application using some obscure law. All you can do is complain and hope.

Everyone has been there man. Just hang in there!

But one certainly has a right to demand an answer(approval/denial) in the time frame suggested(365 to 540 days) and not left in obscureness. We are not lawyers and it is difficult to predict the legal angle that they might take in this case.
Guess what: The illegal immigrants are suing the govt. :)

You want to take a customer service issue to court? And ask for what? An answer that the officers have too many things on their hands? You cannot take AT&T to court for providing bad customer service. You can complain to the BBB but thats all you can do. So we can complain to AILA/congressmen. Unless they have done something against the law (365 to 540 is not a law) you dont really have anything to sue. Illegals sue based on discrimination / rights violation. Now all you are doing is waiting... you know what they will say if you dont like waiting... just what the managers tell you these days... take it or leave it. And they know we cant do anything about that.

Ofcourse you can sue AT&T for bad service, if one can prove that losses occured as a result of it.
As I said before, a good lawyer can suggest on the legal options.

petition in three steps

we must act as a group, otherwise, it will only be considered individual.

I suggest to do petition in three steps:

first; let's list our requests from BCIS, such as a clear timetable to process our application, a clear work progress report for their job on weekly base. we also can ask a more flexible regulation for applicants who are waitting more than certain time., and put it in a simple letter(our requests only).

second, hire a lawyer to represent us and submit the letter , and demand the answers in three weeks, after that, if nothing change, just ask the lawyer to file the suit. we can sue them on bureaucracy, dark office(if we can hire a lwayer, he should find enough reason to sue if he wants the money. I heard Jewish lawyers are very reposible and work hard, but don't have any experince with them)

third. either send our petition to big news papers or to the senators.
