My attorney just got all my paperwork back saying it had the wrong amount for the checks (which it didnt) he called the USCIS and they said they dunno what happened or why and to resend it all in, He got the checks back and everything was all mixed up not at all in the order it was sent and some of the papers where missing. Tomorrow I go in and resign some of the papers that are missing and he is going to resubmit it all but I just dont understand what the problem is and why they have sent it back...I just hope this time it all goes thru fine. Gosh I am frustrated

This is not a very common case, in fact these things should not happen to people with attorneys at all. You pay the attorney for their services. Since ur attorney is incompetant, u shud fire him/her.
 
Sadly, there is a lack of professionalism in the immigration law field... Some are just looking for a fast buck, while others are truly incompetent and immigration law is the only type of law they can handle as they would never survive in the judicial system. I was shocked when I first started interviewing potential immigration lawyers for our case. They would not return phone calls, they could not guarantee they would be available for the interview... And so on. With immigration law, the lawyer is not subject to the same strict oversight of judges and other lawyers who are ethically obligated to "rat" them out if they do anything unethical. I believe this leads to the lack of professionalism.
 
Most of the lawyers do immigration as a part of the list of law they practice. So they usually take the basic easy cases like legal immigrants marrying USC. They just meet with the client and ask the paralegal to do everything. Yes most of them don’t have much experience, but some of them just focus on Immigration law and they are good as they have so much experience. The best way to find a good attorney is to see if they work with some charity immigration services for atleast 10 years or best ones are the ex- INS litigators. It all about experience nothing else and reputation with the INS. If they deal with you and know your clients are usually clean they give them a easy time.

As for oversight, no judge nor lawyer acts as an oversight, it is the state bar and clients are the oversight, if you good people come to you else they dont.
