Since the retrogression came into effect, this forum has really slowed down. Not many posts. Before there was a lot of excitement, POJ's cakes etc.

Most of us have resigned to our fate of years of delays.

Anyway to update. I finally heard back from our Senators office asking for more information to check with the FBI. Hopefully he can help, though overall my attitude towards everything has turned pessimistic. Hopefully not for long!

You are right. Things have been very quiet and I guess they will remain quiet till the PDs progress into this century. This proves that this retrogression is based on future projections and mishandling of visa numbers in the past few years. There just aren't to many cases that USCIS can approve at this point. Currently most of the service centers have nothing to do. They are enjoying an extended holiday season. The funniest part is to see the processing dates each month. Most centers are well into 05 now. What a scam ...

I have at least four colleagues who barely made the deadline for submitting NIW cases on the 30th of Sept. They had been waiting in backlog/PERM/both for years and had no hopes of getting into NIW. However, much to their own surprise, each one of them got ead, parole and 140 approvals within 10-15 days. thats what tsc is upto these days as they dont have to work with 485s
 
any progress with your petition?

Hi Nikkasingh,
I was wondering if you heard anything about your I485 petition. Did you contact USCIS? I know that they cannot approve any petitions. I enquired with USCIS before retrogression (Sept 21) and got response last week..that says my case is pending security clearance! I am trying to contact senator or someone who can help me to expedite it.

Because most of the real work (485 approvals) has been taken away. The least we can expect is for them to approve EADs, APs and 140s. But there is a downside here. The more 140s they approve the worse the need for visas becomes. DOS looks at all the 140s in the pipe that are waiting to apply for their 485s and fearing huge backlogs they do not move the PD cutoff dates.
Not moving cutoff dates adds to the number of people waiting for visas. Classic Catch 22 situation here.

This whole problem of retrogression began because of quick 140 approvals and the stupidly implemented concurrent approval policy. Over the past year or so most service centers approved 140s and 485s concurrently. Since 140 approvals sped up 485s approvals also sped up. People with older PDs whose 140s got approved before the concurrent approval policy or whose 140s did not fall into the quick approval trend got short changed and people with relatively newer PDs reaped the benefits because their 140s along with 485s were approved within months of applying. There was no FIFO plolicy. It was a free for all.

The only solution at this point is for one of the immigration bills becoming law. Till then 140s will keep piling up and thousands will be spent on EAD and AP approvals.

I set my mind to set apart the money to renew my EAD each year! USCIS is very aware of this profit !!

Hi Saras

I absolutely agree with your assessment that this barrage of approved 140s will only add to the woes.

Toxsci I called TSC and got a live person who told me everything was ready but that due to retrogression it couldnt be approved. I then probed her that I havent had an LUD since late June, which would indicate that everything was ready then, so why my case was not approved in July, Aug or Sept, to which she replied that she had already given me whatever information was available.
