Whenever we are thinking about how bad our situation is,
it\'s beneficial to remember that there always people worse
off than you, and your situation isn\'t too bad.
My wife\'s work-colleague filed through her company an EB1-OR
I140 petition, or at least she thought they did.
When the case was issued a RFE she realized the I140 had
been filed as the much tougher Extra Ordinary Alien (not Outstanding
Researcher). The lawyer insisted they always intended to
do this.
The lawyer now claims that CSC is getting very tough on EB1 cases
and got her to file in the EB3 category to be ultra safe!!! Remember,
this is a person with a Ph.D. + 5 years experience, lots
of scientific papers, awards, citations.
It\'s really sad. They filed the I140 in August of 2000. If the
lawyer had done their job, they would have a green card by now.
Instead, they are just beginning to go through labor certification.
Sometimes I think myself and others waste too much time
on this board. But when I hear stories like this, it makes
me feel that I\'m doing the right thing.
