After reading the UCIS memo from Fujie Ohata several times, I am proposing the following theory. The theory applies only for the below conditions
Conditions:
Filing of 140/485 concurrently (doesnt apply if 485 is filed for pending 140)
FP notice already processed
Process
--> Your application has been transferred to a different unit dedicated to adjudicating concurrent applications
--> Existing units will continue to focus on standalone 140s and 485s.
--> Processing times for concurrent applications will be tracked separately. (You may start seeing new line items in published processing times for 140/485 concurrent applications).
--> My guess is that processing date for concurrent applications is Jan 2003 (since 140s would be processed b4 that date)
--> Over time, standalone 140s and 485s will get over and only concurrent apps will remain. At some point, they will make it one single application
--> The new units will be funded thru the hikes in new applications
The effects
--> Backlogs will reduce dramatically for concurrent as well as nonconcurrent holders
--> Concurrent applicats can expect a (dare I say it) Green card along with 140 approval
--> Biggest loser is CP option, since now they have to wait longer...
Outstanding issues
What the heck is Just in time shelf??? how do I get my application to THAT shelf??
Please input your thoughts....this new rule seems to have some serious repurcussions to processing times...
