The VSC -> TSC debacle: Is it true? We have to wait until 2008?

Rumor has it that the I-485 cases transferred to TSC this March are being treated as if their receipt date is March 2007, meaning they will have to wait another 6-9 months for approval, on top of the years already spent waiting at VSC. :mad: :mad:

How true is this? Does anybody have any hard evidence or reliable sources to verify this?

Just talked to TSC officer, and she says that TSC currently processing Oct 2006 I-485 cases and should wait untill the Transfered date(i.e., from VSC to TSC ) becomes current.
Most of the cases were transfered in March, so another 6 to 8 months wait .....

That, plus my observation that nobody on this forum whose case got transferred to TSC this March has been approved (if you see any please let me know).

Anyway, this is absolutely false. Google for the bi-specialization program details or read up on any articles posted across the immigration sites regarding these. USCIS has clearly stated that all transfer cases will retain their original place in the queue, the original receipt date. The transfers are an internal USCIS matter and are not designed to inconvenience its customers, us. It does end up being an irritant, but thats another issue entirely.
The transfers have no doubt caused some delay in adjudications, both for transferred and original TSC AOS cases, but thats to be expected, since the VSC did not send extra personnel to the TSC along with the 20000 transfers. They're trying to do more stuff with the same amount of people. Moreover, in the next month, they'd be facing a flood of new applications given the recent visa bulletin. If anything I would expect them to slowdown.
 
It is ture transfers cause delay. But I don't think TSC or NSC lack manpower to do I485. They no longer process certain cases, for example H1B applications. This save them manpower for I485 and I140.
 
NSC guys are good for nothing

I am regular visitor to this thread. Writing for the first time. Yes it happened with me this morning where I was told that my I-485 dates RD is changed to 15th march the date on which it moved from VSC to TSC. It's such a shame these rep. most of them have no clue what they talking.

I assume the TRANSFERRED cases will be arranged/managed/processed and kept separate. If this is not the case, it will bring a terrible storm for us and USCIS. We could expect "unexpected" glitches/omissions/errors/rfes/delays etc.
I am sure USCIS has already considered these facts and will never attempt to mess up with original RD, PD. To bring up the TD over RD will nullify the PD and would be a big mess for onward filling of applications. If USCIS is honest, the transferred/existing cases will be reviewed based on PD not TD. The newly filed cases will never be reviewed before existing cases.
USCIS has alread confirmed in the publication that TD will not affect RD/PD.
Recapturing of FP is an open observation for transferred cases kept separate and being managed separately.
Why we are expecting the next day after FP USCIS will start reviewing our cases? We dont know what is the volume of notices issued for FP2? We must wait realize that in the first phase USCIS is recapturing FPs (2), in the second phase updating/assigning the cases to adjudicators for review.
Off course, USCIS needs enough time for all, may be atleast 6-12 months or more.
Pray for me I need my EAD before 7/11/2007 before any massive mess-up.
Wait and patients will bring GC one day.

Its absolutely false. But I think they are following the transfer date somehow..

Like they processed/processing the cases recieved on Mar 2, once that days is finished they start the files recirved on Mar 3rd. And in that order without following the PD.

Transfer was based on the Notice date of the 485.

So all the oldest(RD not the PD) cases with NC cleared will be processed and then next next oldest.

This is my thoery base on the recent approvals
 
Maybe what is happening is that it is not the official policy to put the transferred cases behind the existing cases at TSC, but a number of individual adjudicators are deciding to do that on their own because they don't want to rearrange the cases they already had on their plate at the time of the transfer. And the useless USCIS managers aren't checking up on the individuals to make sure they aren't putting the transferred cases behind. So what happens with your case depends on which individual happens to be handling it.

Ok so I called NSC this morning to enquire about my case. The rep. mentioned that my case has been transferred to TSC, which I already knew. She said that since my case was transferred in March and TSC was currently processing applications received in Oct. 06, it will take couple of months for my turn to come.

I reminded her that my application was filed in Dec 2004 and applications must be processed in the order of I-485 receipt date and not the transfer date. At this point she corrected herself, and told me that I was correct and the receipt date does not get reset upon transfer; however it does get reset upon issuing of RFE. This didn’t make sense to me either.

After looking further she told me that my PD wasn't current and it will get current on June 1st. At this point she told me that I can only call to enquire about my case after 180 days have elapsed since my case was transferred to TSC. She refused to give out any further information including name check status.
 
My experience has been that the National Customer Service (NCS) representatives are pretty underinformed.

At one point in time, I had encountered a NSC rep who didn't even know about EB1/EB2 etc!!

Apparently the part about resetting the date is true about RFE. They probably won't reset the receipt date itself, but will treat the case as if the receipt date was the date of the RFE.

There are several important exceptions to the processing times shown below:

Case processing will be delayed if we must ask you for more evidence or information.

If we ask for missing required initial evidence, count the processing time from when we receive that missing evidence.

The case processing timeframe will start over if a customer doesn't appear for an interview or asks that it be rescheduled.
