hi guys...

just read the interpretations of sheela murthy regarding the new internal ins memo at

acc. to murthy it looks like we might get screwed...although she is as vague in explaining the memo as the memo itself...but to me it looks like she is saying that once memo is implemented...all who have filed concurrently may have to wait for long time to have their i-140s...cos i am almost at the verge of getting it...or atleast i hope that way...i want to use ac21...my nd is july 9th '03 and its eb3..

any thoughts?? any one??

but is it not true that only cases filed after april 30th 2004 would come under this processing....this is scarey man...trust me..if old cases would laso come under this cateogry.. i am going to drop my process right away..just pissed of of this double game...

manoj...thats what i thought or was hoping that it is for ppl who are filing after apr 30th...

but as i said earlier acc. to murthy that does not seem to be the case...but again..she has said things in a fashion similar to ins which may again have n number of interpretations...

I believe this applies to all concurrently filed applications. It doesn;t have to be april 2004 onwards.

The memo doesn't state that applications filed after april 2004 would go through this new process.

I am wondering what made them issue this memo, is it because of the law suit or the elections ?

if that is true then how would they collact increased fee from people who filed in the past?

Also then what is the point of i-140 processing dates.

I personally feel that we are missing a part or two here
 
I am not sure whether this process is completely started or not but I have seen some cases that are getting 140 approvals with FP or no FP and some of them were concurrently filed.

I am still waiting for my 140 approval (concurrently filed with FP done) and my ND is May15 2003 and believe me after seeing approvals of aug/sep cases I have lost my hopes of getting approval sooner.

I believe that this new process would help some ways but it all depends on how fast they adjuicate. And also I feel that the new customer login that was recently rolled out might have something do with the new process. So that we can see when was our applications where last viewed.. if it takes longer.

It may also imply that applications might get delayed and we would have to wait longer for even i140 to get approved.

Regarding collecting money, they already increased the price and through the EAD renewals or Visa extensions.

The i140 and 485 processing dates may only be applied to standalone applications.

This is my theory...
