What is the definition of concurrent filing?
Filed I140 and I485 at the same time?
How about my case, filed I140 first, after got the receipt notice, filed I485.
is it the concurrent filing? My I140 was approved. Waiting for approval of I485.

I think if you file your I-485 before your I-140 is approved, it is considered as concurrent filing. Before this new regulation, you had to wait for the I-140 approval in order to be able to file I-485.

Where did you get this definition? Is it just your guess or did you actually see this at some official website? I was under the impression that both have to be filed together in order to be labeled as concurrent as there was compleltely different filing and labeling procedure. I don't where I read this, but there was an official INS document in this forum floating around that explained the procedures right from receipt of applications to adjudications.

Here's the link to the regulation about concurrent filing. See PART 245 in the middle column on page 3, application - part (C). This is the definition of concurrent filing.

This was issued a long time ago. The definition might have changed since then after this new pilot program of adjudicating I-140 and I-485 at the same time has started.

Thanks C514468. That was crystal clear. Only thing I don't understand is why the heck are we not considered for the so called pilot program and why petitions from 2004 are (I am talking about those that filed concurrently back in early 2003 or in cases even in 2002). Anway, this is something no one can answer.

mxc,

The Pilot program was for those whose 140 has not been adjudicated and who filed concurrently. Beacuse it was a Pilot only cases from Feb 2004 were adjudicated. It seems to have stopped for them also as I do not see any posting of late.

'Damned if you get approved, damned if you dont'
