The 10,000 Cap & Derivatives

Hi!Everbody.I have several conserns which I can't find answers as below,please help me with thanks in advance:

1)Once my wife and children come to file their I-485,are they also
limited by the 10,000 cap?FYI,I'm not the asylee for "One Child
Policy".

2)From your experience,hot long would it take for the derivatives
to come to the U.S. after INS's approval?

3)As the time for getting GC is too long to wait,how can I do if I
want to change my status to employment basis?Need I declare
my intention to the employor before being employed?

4)When is the best time to change to employment basis?Before
or after my wife and children's coming?

Everybody's opion will be highly appreciated!
 
1. Yes
2. Hard to tell depending on the embassy or consulate involved. China has been very slow.
3. If you find a match, then hire a lawyer to start the process which will take about 2 years in most cases.
4. The sooner the better.
 
I thought that he was asking about how much time it takes to receive a green card based on a job offer. Two years are a good bet, though it of course varies.

Whether asylees should go forward with the employment-based process is a diffcult call. The 100000 backlog is so so so extreme that you should think they will raise the limit sooner or later. If they do then we would regret spending big bucks on EB and limit our job freedom.

But the wait now is painful and many want to buy a peace of mind.
