My wife still pending with a RFE

Does anyone can suggest if I should try to schedule an interview at this time or should I wait for my wife to clear her RFE and approval?

I would like to share a bit of history on my case, if you're interested:

This journey began back in late 1997 when I came to USA from Mexico with an H1B visa, and the promise of my Employer “A” to sponsor my green card process. Later my employer refused to start with the process until I would complete 3 years of employment. I waited 2 1/2 years, and in late 1999, when I was about to start with the LC process, my Company “A” went bankrupt and was acquired by company “B” and rather than starting the LC we had to amend the validity of the H1-B visa to work for company “B”.

The second part of the journey started on December 2000 when company “B” placed the first add towards getting the LC (RIR process), and in June ’01 we filed my LC. The process took almost 2 years to get it cleared by both TWC and DOL. At the time I got the LC, I had barely 2 months left in my H1-B visa.

We started the Third part of the journey on January 2003 when our I-140, I-485, I-765 and I-131 were filed concurrently (Category EB3). EAD-1 and AP-1 were approved on July 2003 while I-140 was approved on 10/23/03.

On September ’03 Company “B” sold the product division I was working on and the Phantom of Unemployment started chasing me, however my Lord protected me and I was the employee chosen to take care of all loose ends until closing completely all pending projects. I could not look for another job at that time since I was not yet in compliance with the AC21 rules.

Filed EAD-2 and AP-2 on February ‘04 and they were approved on June ’04.

Finally laid off on January 2004 and went to work part time for Company “C” on March ‘04 under the rules of AC21 (I did not notify USCIS of this change). Left company “C” on May 2004 and went to work full time for company “D” (I did not notify USCIS about this change either)

Our I-485 cases were never found in the Web site, nor in the automated phone system. Called multiple times to the National Service Center but I could not get this resolved. Contacted congressman on October ‘04 to get this resolved but noting happened (The congressmen I contacted, later lost in the ’04 election and I was unable to get more help (?) from them.

Despite our cases were not “found” in the automated system, I felt encouraged when both my wife and I got fingerprint notices, which led me to believe that TSC had both our cases. Went for fingerprinting on November ’04. FBI returned FP results the same day. On 11/16/04 I sent an E-Mail to the FBI inquiring about my name check but I have not received a response so far.

Yesterday I received a call from my Attorney to inform me about my approval and my wife’s RFE; immediately I checked the web site and just until then I could get the status on-line. I have not received the approval notice yet.


I choose to write this sequence of events to encourage people who has been waiting for so long, to keep the Faith in our Lord despite there may be lots and lots of obstacles to go thru.

Thanks for sharing a detailed recount of your journey. It was a rough ride for you like quite a few of us here on this forum but you sure went through a lot. Now enjoy the fruits.
