Hi Real Canadian, Sarsas and other experts,
I was wondering if Texas service center is doing pre-adjucation process with retrogressed I-485 applications (India and China) or they have frozen those application.

My PD is Sept 2005 and TSCs I-485 processing dates have passed it. I did not get any RFE on my I-485 yet and my NIW I 140 was approved on Sept 30, 2005. Recently renewed my EAD.

The adjucators field manual (USCIS) says that even though the dates will be retrogressed for some countries, pre-adjucation process will be done with retrogressed I-485s.

Please give your expert opinion.

abhuda,

As far as I know there has not been any official release from TSC stating that they are preadjucating cases. I believe the NSC or VSC (I forget which one exactly) released an official statement confirming that they were indeed pre-adjucating cases. I do believe that the TSC is working on retro cases because a lot of people have received RFEs over the past year. Do not worry if you haven't received a RFE. Not every case receives one. Lets hope that they are pre-adjucating because they really do not have much work these days.

regards,

saras

I am sure, they are doing pre-adjudicating....

Looks at the approval count....so many folks got approved.....the 1st day of the very month - their PD becomes current...

If they are not pre-adjudicating...then approvals should come after 3-6 months from the date when their PD becomes current, which - I have not seen a single case of , yet!

That is a good guess, isn’t it?

Do not think they are doing anything!!

I have not seen a LUD for over 1 year on my or my spouse case. That LUD was in response to an inquiry and there was not an LUD on it for 6 months prior. This makes me think, they really do not even look at these cases.

My PD is Dec 2004 and I have not seen any changes since Nov, 2005 that is when I applied EAD.

Do you think, TSC/NSC pre-adjesticated my file???
