Texas really sucks

A friend of mine spoke to an IIO today. His ND is 02/10/2001. He was really frustrated. He asked the IIO when he will get his FP. IIO told it is taking lot of time because of security check for the older FP's. To get FP notice it will take even more than six months for him. My friend is really confused. If that is the case is there a possibility that processing time of 725-775 days will be moved further. Other service centers says 340-540 days but they do it within 280 days. But texas says 725-775 days but I think it will take more than 1000 days. Texas really sucks. Can anything be done to this?. Why there is such a delay in Texas.
 
CP is very good option for those stuck with TSC ...

if ur consular posts (Delhi and Bombay do, Chennai does not) accept AC-140, u can have ur interview scheduled ~3 months of sending ur AC-140 packet .... I would recommend this for all that are with TSC .... I was stuck with TSC and it took almost a yr for my 140 so I immediately switched to CP and I can say that was one of the best decisions I took :D

how do you change to CP? do you have to be out of the country to change it? I have heard that consular posts you have to stay out of the US.

Is it possible to file CP now

It is more than a year now from I-485 receipt date. Is it possible to change even now from I-485(AOS) to CP. I read articles that we have to specify whether we are going to do CP at the time of filing I-140. Can anyone please clear my confusion. Thanks in advance.
 
Yes it is possible...

Yes, you can still go for CP using AC-140, but not all consulates accept AC-140 applications. I know that Mumbai and Delhi do accept these, but Chennai does not.

You can go to immihelp.com to get all the information, but the gist of it is that you need to file 824 to change to CP, and once you get the receipt notice (which should just take a couple of weeks), you can send all the paperwork directly to the consulate and you should get an interview in about 3 months time.

Remember, you DO NOT have to wait for the 824 to be approved. Just the receipt notice is sufficient.

once a 485 is filed ...one needs to file I-824 ... wait for the receipt (2 weeks) and while waiting get all ur paperwork ready for the AC-140 ..... as soon as u get the receipt send it to the consulate having jusrisdiction over ur permanent address in ur home country ..... u should get the interview ~3 months from the time u send the AC-140 packet to the consulate ....


But before u go towards filing 824, please make sure ur consulate accepts AC-140 .... some of the consulates that do accept are :

Amsterdam, The Netherlands
Guangzhou, China
Hong Kong, China .
New Delhi, India
London, UK
Mumbai, India
Sydney, Australia
Taiwan, ROC accepts AC I140.

AC I-140 at Chennai?

Has anyone tried AC I-140 at Chennai? Anyone suceeded or failed? They say that they will accept AC I-140 on a case-by-case basis ..blah blah.. when the ..blah.. blah.. conditions are met.
 
chennai does not accept AC-140 cases ...

thats really unfortunate for lot of applicants ...

Delhi and Mumbai do accept it ...

I emailed them asking if they will accept AC I-140 with I-824 receipt(without 824 approval). Their reply is below.

On a case-by-case basis, the U.S. Consulate General in Chennai is accepting
employment-based immigrant visa cases for processing when all the following
conditions are met:
INS has already approved an E1 or E2 category immigrant visa petition and
the applicant has an original I-797 form
the applicant is a resident of the Chennai consular district >the priority
date of the case is current or could reasonably be expected to be current
within 60 days (we will not warehouse non-current cases).
· waiting for the INS to process the change-of-status application would
cause the applicant hardship
· the applicant has attorney-certified copies of all pages that made up the
original immigrant visa petition
· there does not appear to be any indication that the case is fraudulent
· and our workload permits us to take the case
If you believe that your case meets these conditions, have your attorney
send certified copies of your I-140 paperwork to the Immigrant Visa Unit,
U.S. Consulate General, 220 Anna Salai, Chennai 600 006 India with
· the original I-797 Notice of Approval Form
· complete forms OF-169 and OF-230, part 1
· an e-mail address where we can contact the attorney with confirmation that
we have accepted the case
DO NOT send any submissions to any officer or employee by name. Doing so
mixes business with personal mail and results in lost paperwork when
officers transfer.
We are accepting E3 cases that meet the above conditions on a more limited
basis, where it is clear that the applicant is highly skilled. We would
accord precedence to applicants who have already received H1-B visas in the
same profession or for the same employer.
NOTE: This procedure only applies in change-of-status cases. If INS has
approved an employment-based petition and you had asked from the beginning
to apply for the visa in Chennai, then we must wait for the case to arrive
from the National Visa Center.
