Texas or Vermont?

Hi ,

I got my labor approved from Pittsburgh. Now my employer has filed for my I140 and I485. From what i understand after reading all these forums , my file should go to vermont service center because my job is in pittsburgh. But the receipts i got in the mail by ucics mentions my service center as Texas. Did my lawyer made a mistake and send papers to texas service center instead of vermont?

Hi,
If your company is head-quartered in TSC area, then your case can be filed
in VSC (due to your job location) or in TSC (due to your company headquarter location).
This is very common.

From what I know, Labor is filed for where you work (As your job could effect the job market in that area.)

I140 and I 485 would be filed from where your company is headquartered.

I am assuming that you company's location falls under TSC jurisdiction ?

Atlanta should be under TSC. So you are OK.

And BTW, as I said in my previous posting, I-140 and I-485 could be filed in
the service center where the employee is working or where the employer is
headquartered. In my case, it has been filed where I work, not where my company is headquartered, where as for some of my colleagues (in the same office) it has been the other option.

My Company is based in Lousiana and I am working in bay area, california but my application has been filed in Vermont like many of my colleagues, some of them got their approval recently. So is it mandatory to file either where your employer is based or where the applicant is based?
 
Before the concurrent filing era, I-485 used to be where the applicant is based. Now because I-140 belongs to employer, its filed with employer's HQ service center and hence is the I-485.

485 will get transfered

Thought we do the 140/485 concurrent filing in the service center where compnay is headquartered , later 485 gets transfered to the location or service center which has jurisdiction over the applicants place of residence.

It is clearly mentioned in the 140 and 485 applications on USCIS website where to file the applications.

This is what my understanding is based on my research from lot of threads for the past two months. I might be totally incorrect also..Guys Please throw your opinions..

Transfers will happen when IIO feels CIS should interview the candidate before approving (there may not be any reason for that by recent trend of CIS). When that happens it will be transfered to a local office where the applicant resides(Irrespective of jurisdiction).

In all normal processing the process will be done at whichever SC you applied; No transfers.
