I\'ve been laid off and should i expect any letter from employer e.g termination letter or something? I have been told that once i apply for unemployment, the unemployment agency would directly contact to my company. So my questions is do i need to ask my company to give me a termination letter so that once i apply for citizenship, they wont raise a question.
Please advise for the normal procedure of being lay off,
Thanks to all :)

Similar Boat

I guess I am in a similar boat, I got my approval notice on a Thursday and got laid off on Friday. I got a pseudo termination letter, but I am worried about anything going wrong.

Advice Please!!

I\'ve seen termination letters before, I do not know how frequent they are. You should get as much documentation as it is feasible. S..t happens, besides immigration issues other suits may hit you. This is America.

usually they give you a letter saying that "as per our conversation with you, we have decided to let go of your services. XXX corp will pay you $yyyy which amounts to x weeks of your salary as severance pay... blah, blah, blah". I know this, as I have seen a similar letter given to one of my family members. All employers like to keep the records straight when they lay off people and hence the letter. this should be enough proof for you of the lay off.

In lieu of termination letter

I did not get a termination letter explicitly saying I laid off. What I got was a "Dear John" over the phone. I called the HR of my company and they said they cant give a letter saying that I was explicitly laid off for "legal" reasons. My question is : Sice I am getting Unemployment benefits from the State of NJ, can I use that to prove to INS I was laid off? After all, you get unemployment insurance only if you were laid off or fired. What do you guys think about this?

What is the reason?

You say they should be interested to have this letter in their records.
Why do you think so?

I was called at home on a Friday evening and told me that is it. Dont come back on Monday. Does that constitute proof by any company that they had given notice of termination? I agai sent a letter to HR asking them to please issue sucha a letter. If not, I may have to seek the opinion of a lawyer who is experienced in Labor law and immigration law.

I have posted the question regarding the termination letter. Unfortuntaly i couldnt get any letter form employer. I spoke to HR and they said that they can give me (General)employemnt verification letter but not stating anything about the reason of termination (layoff).

Please advise what should i do in this case, the severance package doeasnt have any letter its just a regular paystub.
Thanks for all the valuable info to this matter :)

Tjhis is exactly my situation too

I am also in the same situation and I got a general Employment letter saying my position is inactive. I am going to take up on JoeF\'s suggestion and consult a labor law expert. A tip: Amex card holders can sign up for the Legal Service Plan for $10/month for unlimited consultation with one of their Lawyers in the plan. I just got it in the mail so let me see how it works out.
