Temporary green card and divorce

Hi,

I recently got married to USC. I got my conditional green card as well. Now she wants a divorce .If we go for a divorce will my green card be revoked. Should i go back to F1 visa status by enrolling in college again. Pls advise. I badly need some help.
 
if you still love her and you think there is still hope for the 2 of you then try to patch things up...
 
I am trying despeartely from my end cos i love her but she is insisting on a divorce. So i just want to know the options so that i can be in a secure position.
 
Try to get her on a marriage counseling probably she feels that "you are not listen", the first two years sometimes is almost like surviving in the Amazons.

Buy Men are from Mars, Women are from Venus...or 20 hours for a great Marriage.

If she insist and really take actions (e.g. a lawyer contact you, etc.) then you must contact a lawyer that KNOWS about divorce AND immigration related issues.

I agree with the above relationship advice. BTW, you do not have a temporary GC ---- you are a PR with conditions. You cannot just go back to F1 visa status like that.

Should your marriage really not work out, you can file I751 as soon as the divorce is final. You will NOT necessarily lose your GC --- you may remove the conditions, provided that you can prove that the marriage was bona fide, i.e. that the marriage was entered into in good faith.

For this it would be very helpful to hire an attorney to help you prepare the evidence.

Try working on the relationship first --- I know this is not entirely up to you, but do your best. Good luck

I have to disagree with you on Men are from Mars, Women are from Venus ---I thought the book was filled with overgeneralized stereotypes ---- I could not personally identify with them. But maybe I'm the strange one.

Perhaps professional counseling would be in order.

Zombie,

Sorry that you are going through such a difficult process, but as others have said, try to patch things up. Moreover, seek a professional marriage counselors and if possible, at your local church, mosque or synagogue, so that you can show that you attempted to ensure that your marriage work.

Of course, you will be forced to remove conditions on your greencard, but if she files for a divorce, you will have to file individually and submit evidence that your marriage ended in divorce, but was a bona fide relationship. So, marital counselling documentation from a professional organization, church, mosque or synagogues to show that you were committed to the success of this relations. I will put the burden of this initiative on you as a beneficiary, because your wife is not subject USCIS interview, because she not an immigrant. So, get to work and compile as much as evidence as you can, that proof that your relationship or marriage was bona fine. So, the more the proof, even though the marriage might have ended in divorce, could be the tonic which takes you over the hump with USCIS to your 10 years greencard. Also, send her flowers man... whatever she likes, so that you can rekindle the love bugs which convinced both of you to get married. :D :D

If the USCIS denies your removal of conditions petition, then you will be in a difficult position. Since you were are an immigrant right now, I wonder if USCIS will grant you another non-immigrant status such as an F-1 visa, because of your previous immigrant intentions. :cool:

However, my advise is that work with your wife to see if you guys can't work things together. :)
