TD to E-2, doable?

Spouse is currently in US on TD and plans to partner with a USC to open a furniture store in CA. Willing to invest $125k (funds already in US bank account).

My question is if she is able to obtain the E-2 visa, can I still keep my TN status?

If your spouse goes on an E-2 visa, you can either become an E-2 Dependent and obtain an EAD or may remain on TN status with whatever company sponsored you. Is your spouse Canadian? Are the funds traceable to her bank account in the home country or in the U.S.? Has the company already been formed?
