TD renewal by mail (I539) taking more than five months --- should I worry?

1) I got my second TN for a new employer, and we decided to just renew my wife and kids' TDs by mail based on the new TN that I have. It's been more than five months now and we still haven't received a decision. The current date being processed for I539 is several months PAST our receipt date. We called the phone number they provided and it just led us to a message saying that they are still processing our case and will notify us by mail/email when they have a decision. Should I be worried? What else can I do?

2) In case my current TN reach renewal date and they still haven't received any notice, will they be eligible to submit another I539 based on my newly-renewed TN? Also, do I need to renew my TN first (via I-129) before they can renew their TDs (via I-539), or can both forms be submitted at the same time in one package?

3) We have no more close ties to Canada (no house, bank accounts, credit cards, etc.). All we have are a few friends and relatives whom we're still in communication with. Will this be a problem when renewing by mail? What about if I need to renew in persion at POE? (Of course I will not volunteer these info unless I'm asked.) If this is a problem, does anyone have suggestions on how to deal with this question?

-- If the current date is PAST your receipt date, contact the DHS ASAP. Talk to attorney about getting in touch with the INS. (or may be someone here can give some input regarding how to contact them). They have a grace period of 240 days.

-- Both forms should be submitted together - that's the preferred route since u can do the premium processing. Premium processing for TDs alone is not possible.

-- No.

What about if I need to renew in persion at POE?

-- POE renewal (easy/tough) depends upon the officer

Thanks for the above suggestion. I have these follow-up questions:

1) The current date is 2 months past the receipt date, and their old TD has expired for more than 100 days. But they still have over 100 days left of the 240 days grace period. Do we really need to hurry or should we wait until, say, 2 weeks before the end of the grace period before deciding to just apply at the POE? And if we do this, will they give us a hard time at the POE (for not doing it before their old TD expired)?

2) Are they still in status since they have not yet exceeded 240 days grace period (and the application was received prior to the expiration of their old TD)?

3) Is there a chance that I will be “re-interviewed” regarding my current TN if I show up with them at the POE?

4) Lastly, do we have the option right now to submit a new I-539 application and go for premium processing (I just want to consider all possible options for us at this point)?

Thank you for your help --- I’m already getting so nervous about this mistake (should have just gone to the border right from the beginning, or applied for premium processing, which I did not know existed!)

wait until 2 weeks before the 240 days are up. There is no hurry. You will not receive a hard time from the border patrol.

They are in pending status. it is a legal status that entitles them to live in the US.

Yes. you can just send a copy of your receipt notice with a request for premium processing form I-907.

This is WRONG. You do not have a choice of premium processing. Premium processing is not allowed for I-539s alone. It is allowed only if the I-539s (TD) is accompanied with the I-129 (TN) application.
 
If it’s in any consolation it took 153 days from receipt date to approval for my TN.
