I have a GC and my wife is on F-1. We came back in dec seperately wihtout any problem. We are going to wait until
I get my citizenship to file for her GC.

Now the questions is, should we keep our marraige confidential?
Can we file taxes jointly? If so does she have problem to re-enter into US?

We came back in dec seperately wihtout any problem. what do you mean by coming separately? f1 is a pure non immigrant intend visa. if consulate or uscis or poe officer knows even 0.1% that your wife as immigrant intend (by marrying a green card holder) she will not be allowed to enter usa. remember f1 student marrying a green card holder inside usa is different. your wife would have filled arrival/departure card while entering usa. what did she say for immigration intend? NO will be illegal and YES will be impractical. f1 are not like h1/h4. h1/h4 are dual intend and they can easily say no immigration intend and file green card after entering usa immediately - no issues. did you or your wife admit about the marriage or hide it? this as a serious consequences and you really need very very good attorney.We are going to wait until
I get my citizenship to file for her GC. may not be possible. if you or your wife lied and came on f1 visa then it is treated as immigration fraud and severe penalties and may impose permanent ban to re-enter again.

Now the questions is, should we keep our marraige confidential? you cannot keep your marriage confidential to any government or insurance or bank agencies. This will lead you to several lawsuits, fines, penalties or jail terms.
Can we file taxes jointly? how can you include her in your tax return if you wanted to keep your marriage confidentialIf so does she have problem to re-enter into US?

The question depends on what you want to do .
Why do you want to keep it confidential ?

If you want to keep it confidential, then why talk about joint tax returns ? Thats an oxymoron...


You can fully go ahead and declare your marriage. And once you have your US Citizenship, then you can sponser her...
