Hi,

I requested for tax return transcripts of the last 4 years from IRS division in California. It has been over two weeks, I have not received the transcripts yet. We need to submit these with N400 application. Should I wait for it or just submit the federal return and W2 copies of the last 5 years. Please let us know if you have any experience with the above conditions. Thanks.

You do not have to submit transcripts with your N400. It is a good idea to take them with you to the interview.

You do not need to submit tax transcripts with the N400. You can carry the transcripts to the interview.

If you do not want to wait, you can collect the transcripts in person by visiting your nearest IRS office. You will need to show your drivers license and social security card. You can get tax transcripts for the last 3 years and account summaries for the years before that.

The IRS locations can be found at this link:

Do you have to take Tax Transcripts to the interview in all cases(Employment based GC) or only if it is a marriage based case?

Take tax transcripts or copies of tax returns to interview. They always ask for it if you are married. But even if you are not, there's no harm having all your documents with you. Better to be prepared than sorry.

I was only able to get Transcripts & copy of Tax Returns for the past 4 years(2005-2008). For the 1 year prior to that (2004), I was only able to order a Transcript. The recording said copy of the Tax Return for 2004 is not available, unless I use a Form 4506 and there is a $57 fee for it.

How is Transcript different from copy of Tax Return?

Is the Tax Return I filed through H&R Block sufficient or do DO's want it on IRS letterhead?

For the federal transcripts and balance sheets, you can also request that they be faxed to you. The times that I have called, the agents have been helpful and confirmed that the faxes were received successfully before ending the telephone call.

Just an alternative if you are concerned about waiting for the mail.

You can show either the IRS transcripts or your tax returns copies, but the IRS transcripts are preferable because of its mark of authenticity. I myself brought the IRS transcripts for four years 2004-2007 and a copy of tax return for 2008 as I had just filed it a few days before my interview. It turned out that my IO did not even look at them, and when I asked if he wanted to check them he replied it was not necessary since I was not married. He said he'd only check for marriage based cases. But as I said earlier, take all the documents with you (check the sticky threads) whatever your status because not all IOs have the same approach.

Tax transcripts are only required it you are filing based on "three-year marriage". Regardless of how you are filing, if you have any lenghty absences, or any other problems you think may occur during your interview, it can't hurt to have them with you.
