Tax returns..still need explanation

Hi..My husband who is the sponsor..doesn't have tax returns and my Father-in-law who is sponsoring us showing finanacial evidence. Does my husband still need to write explanation letter for not having tax return or is it OK becos we are having joint sponsor/?..

Tax return docs are not available or tax wasnt filed at all?

If tax was filed but tax return documents are not available, you can call IRS to get a tax transcript for the previous three years.

If taxes were not filed, sponsor must backfile taxes with the IRS. Having a joint sponsor is not an excuse, sponsor must still submit a letter with explanation as to why taxes were not filed.
 
Hi ari4u..thank for your reply.My husband has 2 yrs tax returns and only 1 yr is missing as he didn't work at that time at all.I think we will still send explanation for 1 yr.

I also wwant to know..my father-in-law who is sposoring does not have recent tax return..as he is still waiting for it.Can he send years 2003, 2002, 2001..would it be a problem for 2004?

In the instructions they ask for 3 recent year tax return. Now if you don't have any of them you need to provide an explaination. He can send 2003, 2002 and 2001 with explaination for 2004.
