Tax Returns and/or W2 forms

I am a Software Consultant with MS in Computer Science. I have been living here for the last four and a half years and I have no dependents. A Software consulting firm is currently holding my H1-B visa. I have been on bench (without pay) since the beginning of this year and I don't know whether I can find a project in near future. Another Software conusulting company in Delaware is willing to sponser my Green Card (GC).

Do I need to submit my tax returns and/or W2 forms to INS at any stage during the GC processing?

If yes, how many years of tax returns and/or W2 forms are necessary?

I don't think that my employer is going to send me a W2 form (for year 2002) if I can't find a project in the last quarter of this year. In that case, would it lead to any problem during the GC processing?

Your help would be appreciated.

u don't need to submit W2/Tax returns to INS unless asked for.

U can be into a problem if an RFE is generated by INS asking for last few paystubs and 2002 w-2 (granted it happens next year) and u can't provide the same.

get some paystubs..

Raj,

You get few paystubs from your current H1 holder... it can be even for very less amount... tell your H1 holder taht you will pay for the employer tax, employee tax and other costs.... you pay it... and it will make your status legal...

Very important even for transferring the H1..
