Tax returns and living abroad

Hi,

Got a question about tax returns, I have been living abroad for the past 6 years until now. I didnt work while abroad, basically my parents who have a business abroad financially supported me and my spouse. I since moved to the US and got a job, now once USICS requests tax returns, which I didnt file obviously since I made no income, what do I submit? Was I required to file even with 0 earned foreign income? I contacted a expat tax returns company who told me I dont have to file if I did not earn foreign income.

Any help on this?

Whether you were required to file a tax return is based on whether your income is above a certain threshold, which can be found in the respective year's Form 1040 instructions, near the beginning in a section called "Do You Have To File?". As a US citizen, there is no difference in regards to this between if you lived in the US or abroad. The only legitimate reason to not file for those years is for your worldwide income for those years to be below the threshold. Whether you were abroad is irrelevant. If you were not required to file because you were below the threshold, then per the I-864 instructions, you need to attach a statement stating this, citing the threshold and how your income was below it. You would check No on Part 6 #18a, put "did not file" on those years you did not file for #19a-c, and check the box in #20.

Is there a sample letter I can find or someone wrote in regards to not filing taxes for those years I been abroad?
