Tax Return during I-485 pending

I was J-1 until Nov 31 2003, and then have H1-B from Dec 1. I also submitted I-485 last November. So I am currently I-485 pending, but I use H1-B instead of EAD. By the way, my wife is using her F-1.

Now, I need to file the Tax Return Form. What kind of form should I use? How to file it?

Not only was your question really out there in the left field, but this is not the kind of question that you want answered by anyone other than a good CPA.

The IRS unlike the INS is EXTREMELY apt and really does its job well. If you screw up on your taxes you can rest assured they will come after you. So don't look around for cheap (read free) answers on this count.

If you have NO bloody idea what taxes are all about, (and going by your question it definitely seems that way), then you absolutely need to talk to a CPA!
 
Or try a tax software such as TurboTax. You can always file form 1040 if you could not figure out the right form such as 1040EZ or 1040NR.
 
Your tax return is independent of your visa status (Unless you are on an F1 - wherein you are a non-resident for tax purposes).

Depending upon your residency - u would use a 1040NR or a 1040. because the spouse is on an F1, both of you have to make the declaration of choosing the non-resident to be treated as a resident in ur MFJ app.
