Situation: My friend got her GC because her father got his GC and she was under 18. She moved to US 5 years ago and lives with her uncle since her father had to go back home for some business. She is now 22 and completed her 5 year residency and so applied for N400. She is a full time student and works only during summer time. She does not need to work cause her living expenses are covered by her uncle and her dad pay her tuition.

I have read that few of the interviewees were asked how are they supporting themselves since they do not work. My friend will tell the truth that her uncle covers her living expenses and dad covers her tuition. I do not think this will be an issue.

Question: Should she have indicate on her tax return the money her father gives her for tuition (as a gift or other income or something like that)? She has never indicated that and I do not think that she has to since she is a dependant. Is this money considered as a gift and so she has to have had indicated it on her tax return?

I know this is more of a tax law question but any input will be appreciated.

If she filed tax returns during the last 5 years, She would need tax return transcripts from IRS. Money for tuition may come from parents or as a loan from a bank. It is not earned income so there is no tax liability but if she receives a big chunk of money from parents as a gift she needs to report on her returns. This is my opinion but not a tax advice. She may consult a tax professional for a specific tax question.

I seem to remember that an amount under $10k-$12k per year is not taxable per year for 'gift' purposes... Now, whether that needs to be put on a tax return, that's well beyond my tax knowledge.
