Tax after GC

My Friend got his GC already. But, he realized that he didn't pay state taxes for last two or three years. Is it OK or will it give any problems in the future (for GC).

If he moves to other state in the future, he still owes the taxes ?

If he has to pay the state taxes, can he file all 3 previous years taxes at once.
How it works?

It's not OK - whether someone is GC holder, citizen or working on visa. It can be a problem in future if he is convicted for not paying tax. Otherwise, if he pays all the due taxes and penalties, there won't be any issue.

Yes, he owes no matter where he goes - other state or out of country.

In most of the states, including Federal, longer he waits, his penality will go up astronomically. So, now it's upto him whether he wants to pay now, or on next tax day.

How it works?


I know a professor who is too absorbed in research. So he never
file state tax return (but state tax is already withheld
so most likely the state is benefit by his failure to file).

He just filed his application for citizenship and he
answered No to "Have you ever failed to file
a federal or state tax return".

I do not know if he ever made up. But I doubt he would have
any problem getting teh citizenship.

My observation is: No one cares. If one indeed
get into trouble, the only blame is bad luck.
 
State tax "X" and "Y"

My friend said that...He is working and living in state "X" and his employer paid state taxes in state "Y" (Employer's state). Employer withheld taxes for state "Y".

So, what is the solution for this?

Can he get the credit from state "Y" and use that credit in state "X".

Does he have to file all the old pending state taxes if he owes with penalty?

It's your employer's mistake. Citing this reason probably give him relief for all the penalties (if any at all). I would recommand him to talk to a good tax consultant. Spending $100 or $200 is nothing compare the ordeal his has to go through. In fact, as this is employer's mistake I would talk to employer so that they can arrange to sort it out or pay for all the tax consulting fees.

On the other hand, I am not sure how your employer did that mistake. Are they paying you as showing the resident of state Y (which is not very uncommon to use that kind of loopholes)?

Yes, if his employer paid all the payroll taxes by mistake, you can get them back. Talk to your employer. As they are living in that state Y, they will be able to tell better how to get it back.

Whether he owes or nor, filing tax return is mandatory for most of the states (in my best knowledge).

After talking to my friend. He gave me more details about this case:

He said, His Employer has office in state "X" and he filed his GC in that state. So, for the purpose of GC, they generated payroll from that state.

But, he is living and working in another state "Y". His employer said, no need to file state taxes in state "Y".

I know that, my friend's employer is a stupid, doesn't know the tax laws (Another stupid Desi Company).

So, here are his choices:

1) My friend should file state tax returns in state "X" and use that credit for state "Y"

2) Ask employer to get the refund from state "X" and regenerate payroll from state "Y", send new 2, I don't know the possibilities

Friend said, his employer is lazy and stupid, he might not do the option 2.
Is there any other option ??

BTW, he got his GC already, so the tax thing won't effect the GC, Am I right?

For your friend's interest, option 2 is better (but not sure how much feasible). His employer did the mess for wrong reason (GC location) which does not conform to the tax laws. The employer showed that your friend never existed in state Y. And it's nothing but using loopholes of tax systems.

No, it won't affect his GC at this moment. But tax problem itself is a big problem which can haunt him in naturalization.
 
tax change

After getting greencard, do we have to pay same amount of tax rate, is there any increase or decrease?
