Tax advice needed for some one on bench

My friend is on H1 and has been on bench for the last 16 months without pay..Does he still need to file taxes with IRS? His company has not given him any W2.

I mean does he need to file a $0 tax return.. Will it be any issue if he skips the year 2002 taxes though he was physically present in this country?
 
If you dont have a W2 you cannot file.

Basic requirement for filing a Tax return is a W2.
Now whether your friend is entitled for a $0 W2 is a different issue.

I dont think its a problem (from an IRS perspective) if you dont file a Tax return.

But obviously its a problem from an INS Perspective. He is out of status since he doesnt have a paystub.

Dont worry just take it easy .. find a job and he should be OK.

16 months is way too long to be on bench without pay. Why is your friend still with that company?

Taxes are paid on income. If your friend had no income he owes no taxes. If he did not have income above some limit (check the IRS form 1040 instructions) he need not file tax returns. However, his immigration status in US is questionable.
