I talked to an IIO this morning regarding my case RD 04/09/00 ND 05/09/00 FP 01/26/00 PD 10/96 NSC EB2 India, he said that they are waiting for my original I140 petition and that after they get it they would process. If after 3 request they dont get the response they would go ahead and adjugate the case, any insight into this will be very much appreciated. Thanks

By any chance, did you select CP on your I-140 petition?
If that is true and you have received Packet III from NVC, then your I-140 petition has been sent to the consulate in India.
This might be what IIO might have tried to explain.

No I have not selected CP on my I140. I think he said that they needed the I140 approval for filing with my case. Thanks

I spoke with IIO todayand he said same about my case. Is specific word
he said they are waiting for the I-140 petition to be with rest of the documents. And that he can\'t tell when taht will happen. LIN-00-158-XXXX ND 05/2000

st spoke with my lawyer and she said that they are researching if the job that was filed on the I-140 is same today or if the employer is same etc. ..so at least we know they are working on it and it will take 2-3 weeks to complete that.... hope this helps you too...

did you send the employment letter with the yellow form which came with your fingerprinting notice ?? or did you change job in between or your company name had changed ???

Did they say how far apart these three requests are? I am in a similar situation. They put my Amended I140(Due to a company merge) into an "outside storage facility".

They said they dont know how many requests they had made and if after 3 requests they hadnt received they they would adjucate it without that.

I managed to talk to a live IIO this morning. I was told that they had found my missing I140 paper and my case was assigned on 06/29/01. Have my finger crossed now.

470 days and counting.
