Talk to VSC center today, what to do next

I-140 RD 09/03 AD 06/05
I-485 RD 07/05 Pending

PD became current 2 month ago.
I485 last LUD 08/05 for receiving finger print result

Called VSC this morning, was told firstly case pending for finger print results. After I pointed out that online message said finger print recevied, the lady looked again and told me that pending FBI invesitigating. She also added that the investigation mat takes years for some people. I requested a reference (or inquiry) number, but was declined.

Does that mean "stuck in name check" -the worst thing that I can image?

Should I go ahead for a "lawsuit"? Any thoughts are welcomed.

it is a difficult situation to be in, but the good thing is that your PD is current.. so hopefully ur case should move..

you should be patient.. call them again in 3-4 weeks if you do not have any LUD's..also remember do not call USCIS too many times...

EB2 cases are getting approved quickly now.. so your case should come through...

Most probably - yes, unless the lady just wanted to get rid of you.
Call them in a couple of weeks.

Stuck on Security Clearance

Hello huxf,
My 485 has attained current status from processing side and PD has been current since Jan 2006. I called up VSC last week and came to know that mine and my spouse 485's are pending on security clearance since July 14th, 2005 (close to an year). So we are also stuck on security clearance. I am not sure what to do now. Please post the useful info how to come out of this situation.

Any ideas, tricks, tips, suggestions,guidance etc. is highly appreciated. Kindly let me know.

Priority dates being current does not mean that you will get your case adjudicated at any time. After being current its still another que. Once you receive RFE, it usually means that your file is in the "review line" and some officer is looking into it. No one can help this.

Give USCIS reasonable time, then approach congressman/sanator, then you can think of filling the writ of mandamus. For filling a case, one needs to show that all other sources were exhausted.
