I'm currently on H1B and have filed my I-485 last May. I'm the dependent on this application and my wife is the primary, hence I'm free to convert to EAD if I so choose.
Being on H1 so far, I didn't see a need for an EAD.
However, I've had a good interview recently. The employer likes me but is dithering over the H1B transfer. The position is a good one and I'm thinking of applying for an EAD and using it for this job.
If the 485 is denied for any reason, will I be able to get back to H1B as I still have 2 yr 8 months left out of my six year quota.
I recently read in a couple of threads that I would then not be counted against the annual quota of H1 visas and should be able to get it any time. Is this correct?
My last I-94 with which I entered the US has expired and I'm living off my new I-94 given out with my latest H1B approval notice.
Can someone advice about what I need to watch out for?
