switching employers on H-1

My current H-1B visa from employer A is good through 06/30/2004 . I just got a job offer from employer B. If I accept it my old job contract will end on 06/30/03 and my new job will start on 07/01/03.
1. If employer B doesn't file the H-1 petition by 07/01/03 (they are kind of slow and time is short) will I be out of status?
2. I've heard that if I don't cancel my old H-1, once my new H-1 is approved, they will both count towards 6yrs limit cumulatively. Is it true and if yes what are the right steps to take here?

Are employer B doing a H1b transfer for you ?
you can work for them only after you get a receipt of application from the ins.

1)technically yes.
2)no

actually in transferring an H1 doesn't require the receipt from INS....u can start working for the new company as soon as u mail the petition. I did that...just make sure to keep a receipt of your mail, usually Fedex or UPS receipt...and aslo you won't be out of status till a certtain period of time elapses since your last termination...usually 60 or 30 days..pls check that with your attorney.

thx
