Hello All,
If you could share your experience or advise regarding the following situation, I'd appreciate it.
My 485 was recently approved. This is not concurrent filing - I140 was approved before 485 filing. I stayed with my sponsoring employer for 14 months after 485 filing and then got laid off(end of April). Joined my current employer Mid-May. Did not inform INS about job change(my attorney said we could either proactively inform INS or send in the AC21 letter when an RFE was generated, we were discussing the two options when the approval letter came). My question is: am I ok or will not informing the INS cause me any trouble?
My understanding of AC21 is, so long as the job duties are same/similar, 140 is approved and it has been 6 months since filing of 485, you can use AC21 and INS 'expects', not mandates, that you will inform them.
Please share your thoughts/experiences about this situation.
Thanks very much,
Dharma.
