Hi guys,

Right now my status is H-1B. My I-140 and I-485 received on Feb 07, 2004. I am planning change jobs in the next couple month. In order to avoid restart the whole process all over again, do I need to wait until my I-140 approved then considering switch jobs? Or as long as I-140 received for more than 180 days, I can switch jobs without getting I-485 process interupted.

And also I am on H-1B, I did not apply for EAD. Is this gonna be a problem when switch jobs with 140 and 485 pending?

Any info is helpful, thank you very much!

According to USCIS interpretation, you should wait till your 140 is approved before trying to use AC-21. If you do not do this, you will get a most likely possible denial (provided your company revokes your 140). Anyway, your 140 is so close to adjudication, I think you should wait to a couple of months more.
