I am currently working for “company A” on H1 and H1 is valid till Dec 2006. My visa has expired in 2003 and I currently don’t have the visa stamp.

“Company B” has sponsored my G.C (Labor Sub; PD: July 2001; Future employment) and my EAD, AP, 140 are approved.

If I leave “company A” and start working for “Company B” on EAD, can I go back to “Company A” and work on H1 (if any thing happen to my 484) ?. Do I need to re-apply for H1? Do I need to go out and get stamped?.

In short, can I go from AOS to H1 any time if I have time left on my H1?

Check for Question 1. Talk your attorney.
In other words, porting under INA §214 does not require that the alien currently be in H-1B status as long as he or she is in a “period of stay authorized by the Attorney General.”
