Do you need surrender certificate with a cancelled indian passport? Answer is 'NO'. See details

My wife and I have received us Citizenship in Oct 2008 and have subsequenty received OCI in Dec 2008 and have sent our passports for cancellation when we received our OCI. They were returned with a 'CANCELLED' stamp.

Do I need to get surrender certificate. Based on the new Surrender certificate rules I have until 3 years to get my surrender certificate with a $20 fee without any penalities. After 3 years if the indian passport expires after Jan 1, 2005 there is a penalty for non cancelled indian passport.

So I plan on sending both mine and my wife's indian passport with the following documents and ONE return envelope for both our passports and surrender certificate. If there is anything missing in the list can anyone who has done this recently let me know ASAP. Thank you for your time.

Documents to send.

1. 2 copies of SC filled for me and my wife separately.
2. $40 processing fees as money order.
3. 2 copies of indian passport first 5 and last 2 pages for my wife and I.
4. 2 copies of naturalization certificate for my wife and I.
5. 2 utility bill copies for proof of address.
6. ONE return envelope for return of cancelled indian passports and surrender certificates.

Ignore my post. I got more information from the chicago consulate website. See link. This clarified my question that I don't need to apply for surrender certificate if I already have a cancelled indian passport.

Please note that if you have acquired US (foreign) Citizenship on or before 31 May 2010 and if you have "Cancelled" stamp on your Indian passport, then there is a no requirement of acquiring "Surrender Certificate". If you do not have a cancelled stamp on Indian passport then you need to get the "Surrender Certificate". However fees for that is US$ 20 only.

That is correct and the CGI NY website also says the same thing on their Renunciation page:

"Persons of Indian origin who acquired foreign citizenship on or before 31st May, 2010 should approach the Consulate for cancelling their passports if this has not been already done. They will have to pay cancellation charge of US $ 20 per person in addition to mailing charges of US $ 20 (per family). For those who have already got their passports cancelled after acquiring foreign citizenship, no further action is required."
 
Thank you for your feedback JPBoston. Chicago's website just had a clear explanation with stating that 'CANCELLED' stamp passports are ok and do not need a surrender certificate. It was conflicting with instructions I have seen earlier were CANCELLED ON ACQUISITON OF FOREIGN CITIZENSHIP stamp was needed. Thanks!
