Hello Friends

Do I need Surrender Certificate if I already have OCI?

Does anyone know of any link that could clarify it either way?

As I mentioned in my earlier post that I got the OCI in the first week of June, but they did not cancel my passport. Now I will be travelling to India in Mid-July and people all around me are speculating that I will have trouble at the airport as I do not have the SC or Cancelled Passport. I spent almost an hour on this board today, but probably missed any post which clarifies it.

Any help is greatly appreciated. Thanks in advance.

Hi,

One of my friends, who visited India and came back couple of days ago, told me that Indian immigration people did not ask him surrender cerificate or anything. He got his OCI last year but do not have surrender certificate. However, it is advised to obtain one because, if in case in the future you want to seek consular services, you might be asked for one. So, if I were you, I would apply for surrender certificate by paying $20, since I pressume that you got your citizenship before June 1st. I wish you all the best.

Hello There

Thanks for your response. I agree with your suggestion. I would go ahead and apply for SC.

My wife was giving me hard time since her friends told her that their friends told them that they are stopping people at the airport. However, I was following this forum for quite sometime, and did not see any reference to anyone asking for SC at the airports in India.

I asked all of them to send me one link or any other reference, that would suggest that people are being asked about SC at the airport, but I was shot down for being too arrogant to not listening to anyone. Due to the misinformation all around us, sometimes it becomes difficult to explain the actual situation.

I have no problem applying for SC as we all know that rules could change any time or I could have a difficult time when I am ready to renew the OCI, but I did not want to apply just because someone said that its the new "requirement" for the OCI holders as well.

My understanding of the SC is that its a "requirement" to get the "consular services", but not a "requirement" from the "immigration" point of view, hence the "immigration officers" have no interest either way.

I spoke to two of my colleagues who recently went to India and they also said that the immigration officers did not ask anyone about SC.

Thanks for helping me get my sanity back :)

There you go. It is to avoid fraud if you use the non-cancelled passport illegally, not to harass people at the airports. At least, that is what I would like to think. :)

I am still a bit confused. I obtained my US Citizenship in March of 2009, that is, before June 1, 2010. and both my Indian passports were sent to DC Embassy for cancellation while my OCI was being stamped on my American passport. Now I have two cancelled indian passports, and A valid American passport with OCI in the passport along with the registration card. Do I still need a surrender certificate ? Please help ...

You definitely don't need a surrender certificate - in future when you need any services from Indian consulate, submit a copy of the Indian passport with the "cancelled on aquistion of US nationality" stamp.
