DETAILS I MARRIED LAST YEAR APPLIED 2014 JUNE APPROVED IN JAN 2015.

DID NOT FILE TAX RETURN BECAUSE I WAS DEPENDANT ON MY DAD (SCHOOL) CURRENTLY LIVING AT HOME

I STARTED WORKING SINCE 2013 OCTOBER MADE 11,000 USD FILED TAX RETURN NO DEPENDANT

2014 RETURN MADE 40000 WIFE AS DEPENDANT

MY DAD HAS TAX RETURN SINCE 2000 HAD 60000 USD SALARY PER YEAR. HE HAS HIS WIFE AS DEPENDANT LAST 2 YEARS BEFORE 2013 MY NAME WAS IN HIS DEPENDANT.

THIS YEAR I MADE MORE THAN THE POVERTY LEVEL OF 20000. LASY YEAR I MADE ONLY 10K

IN THE I 864 FORM IT SAYS SPONSOR LAST 3 YEARS TAX RETURN.


CAN I ADD MY DAD AS A SPONSOR TOO WHICH FORMS TO APPLY?

First, the I-864 and related forms require a copy of the tax return for just the last 1 year (3 years is optional). However, there is also a question (I-864 Part 6 #13a-c; or I-864EZ #19) which asks you for the "total income" number from your tax return for the last 3 years.

Second, whether you file a tax return and whether you can be claimed as a dependent are separate things. You are required to file a tax return if your income for that year exceeds a certain threshold (which can be found in the beginning of that year's Form 1040 instructions), even if you are claimed as a dependent on your dad's return. The only legitimate way you can not file, is if your income was below that threshold. Your dad claiming you is not relevant. According to the I-864 instructions for the question that asks for the "total income" number from your tax return, if you did not file for one of the years because your income was too low, just attach an explanation. If this is the case for you, simply write "did not file" in the space for the "total income" number for that year, and write a statement saying that your income was less than the threshold to file, quoted from the Form 1040 instructions for that year. This is not an uncommon thing.

I-864 is the general form and I-864EZ is the simplified version that has less stuff. If you satisfy the three conditions at the beginning of I-864EZ, then you can use I-864EZ or I-864; they will come out the same. If you do not satisfy the three conditions, you must use I-864. I-864A is filled out by one of your "household members" if you need to include income from a "household member" to count toward your household income on I-864.
