My wife applied for I-485 for her, my son & myself through her company at Nebraska service centre. receipt & notice dates ( July 13 & Aug 24 2001)
Now her company is bankrupt and closing.

I got an approval for I-140 through my employer on Oct 3rd 2001 from Vermont service centre.

What is the best solution ?

1. Cancel my wife\'s case and go ahead with mine ?
2. Can we merge our cases ?
3. Is there any other better way .

Please advice.

I think you would have withdraw the other applications and apply 485 based on your 140 approval at VSC. I am basing this on couple of posting on the net. Search for multiple applications on this site. Sorry couldn\'t help you more.

It\'s not complicated

You can simply apply for her and your son through your application. I don\'t believe it\'s much of an issue if you have 2 applications for AOS going. I\'m given to understand that as they are under 2 separate I-140s, you can both apply under boths names. So, apply for your wife and son in your name - you\'ll get her a new and updated EAD, and she can continue to work at a new company.
 
I am struggling with the same issue

Hi, KVP1, I was in the same situation. Search for "multiple I485" and you will find some postings there. Basically, both my husband & I already applied for I485 based on his I140. My I140 was approved a couple months after his. But I work for a much larger & stable company. I was contemplating filing a second AOS and was gathering information regarding multiple I485\'s. I called several attorneys and I even called IIO at INS national service center. I got contradicting answers. In the end, I concluded that there is no clear answer to the question. You just have to try and see how it works out. It also depends on the officer who handles your case. Anyway, based on all the information I gathered and the suggestions posted, I think the best scenario would be you amend your case, substituting your wife\'s with your I140. This way you get to keep the RD & ND instead of starting over again. But there\'s no guarantee this will work. But it worth a shot. The next best thing to do is to file another sets of AOS petitions. If VSC finds out that you have two petitions pending, you can always drop the ones filed based on your wife\'s I140. Please note, these are just my opinions and does not constitute as legal advise.
