I came to US from Canada (Canadian PR) in April 2000 as a visitor and got married little later to US PR.
Applied for my labour (EB3) in April 2001 got approved in October 2002. Applied for I140/485 in April 2003 and was denied for "inability topay" in Dec 2003. Opened MTR in January 2004 and since there was no reply for few months, reapplied I140 in June 2004 and got approved in Nov. 2005. In August MTR was rejected and applied for I485 and EAD in Dec 2004. EAD approved in Feb 2005. Applied for AP in Nov. 2005 and got approved in Feb. 2006.
Started working for the Sponsoring company since March 1st 2005.
While this was going on, went back and forth to Canada few times till 9/11/2001, never got Passport stamped while travelling by road (They looked at the passport and canadian landed paper and let thru). Got passport stamped in June 2001 while returning from India (stamped unitl n/c or n/l ,hand written,cannot read clear). In august 2001 went to Canada and came back by road.
Now the question is can I use AP and trael to Canada and back ? does 3/10 rule apply though I never had a I94 (I94, I believe).
Any information is helpful in deciding the trip !.
P.S Spouse is eligible to apply for citizinship soon, nextmonth. is that a better route to take. I didnt want to go that route to get things on my own
