Suggestion on GC application

I have filed my NIW application at this July (ND 07/29/2003). However, the case has still not processed yet. I have some
thought in mind and would like to ask your opinion.

1) I am currently working as research associate and my company colud file my GC application in the category of outstanding researcher. Could I file the application at this time evan I have not received the response of my NIW application?

2) Since I did not received any response of my NIW application from NSC, could I file I-485 now in order to initiate a concurrent processing to prevent the piling up of my NIW application?

2) Yes, you can. I don't understand what you mean by "piling up".

Thank you very much for your information.

About filling I-485, if my I-485 application were rejected, would it affect my NIW application? Will my non-immigration visa H1 still valid and could I legally stay in USA?
 
Your 140 has to be approved before they look into your 485. You're right, you can file for your 485 and put it in the queue, the only risk being, if your 140 is rejected, then your 485 is rejected as well.

If your company is willing to sponsor you under OR category, you should definitely take advantage of that to increase your chances.

H1 is a non-immigrant visa for your current job. 140 is for your future job with your employer. As long as you maintain your current H1 status, it should not affect your NIW application in any way ...
